Terms of Service
Please read these terms carefully before using the Data Island platform.
1. Acceptance of Terms
By accessing or using the Data Island platform, website, APIs, software, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.
2. Description of Service
Data Island is a sovereign lakehouse platform developed and operated by Kladna Soft Kft. ("Company", "we", "us", "our"). The Service provides:
- A self-hosted and cloud-hosted lakehouse engine for storing, querying, and managing structured data
- REST APIs, Python SDK, OData endpoints, and MCP server for programmatic access
- Web-based management interface for administration and monitoring
- Role-based access control, audit logging, and compliance features
The Service is offered in multiple editions including a free, open-source Community Edition and paid Enterprise and Cloud editions. Additional terms may apply to specific editions.
3. User Accounts
To access certain features of the Service, you may be required to create an account. You agree to:
- Provide accurate, complete, and current registration information
- Maintain the security of your account credentials, API keys, and access tokens
- Promptly notify us of any unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
- Use the Service to store, process, or transmit content that violates applicable laws or regulations
- Attempt to gain unauthorized access to the Service, other accounts, or connected systems
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any proprietary components of the Service
- Use the Service to develop a competing product or service
- Resell, redistribute, or sublicense access to the Service without prior written consent
5. Your Data
You retain all rights to the data you store in the Service ("Your Data"). We do not claim ownership of Your Data. You grant us only the limited rights necessary to provide the Service to you.
For self-hosted deployments, Your Data remains entirely on your infrastructure. We have no access to Your Data unless you explicitly provide it to us for support purposes.
For cloud-hosted deployments, we implement appropriate technical and organizational measures to protect Your Data in accordance with our Privacy Policy and applicable data protection laws.
6. Intellectual Property
The Service, including its design, architecture, source code (except open-source components), documentation, trademarks, and all related intellectual property, is owned by Kladna Soft Kft. and protected by applicable copyright, trademark, and other intellectual property laws.
The open-source components of Data Island are licensed under their respective open-source licenses, which govern your use of those specific components.
These Terms do not grant you any right to use the Company's trademarks, service marks, or trade names without prior written consent.
7. Payment and Billing
Paid editions of the Service are subject to the fees described in the applicable pricing page or order form. Unless otherwise agreed:
- Fees are quoted in Euros (EUR) and are exclusive of applicable taxes
- Payment is due within 30 days of invoice date
- Subscriptions renew automatically unless cancelled before the renewal date
- Refunds are provided in accordance with applicable consumer protection laws
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, upgrades, or emergency repairs.
For self-hosted deployments, availability is your responsibility. We provide documentation and support to help you maintain your deployment.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied
- In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages
- The Company's total liability for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim
- These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise)
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or willful misconduct.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
Either party may terminate these Terms at any time by providing written notice. Upon termination:
- Your right to access the Service ceases immediately (except for the Community Edition under its open-source license)
- You may export Your Data within 30 days of termination
- Provisions that by their nature should survive termination will survive (including Sections 5, 6, 9, 10, and 12)
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Budapest, Hungary.
For consumers residing in the European Union, this choice of law and jurisdiction does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
