Kladna Soft Kft. – Terms of Service

1. Acceptance of Terms

By accessing or using any services, software, or data warehousing solutions ("Services") provided by Kladna Soft Kft. ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must immediately cease all use of the Services.

2. Service Description & Non-Production Status

Kladna Soft Kft. provides cloud-based data warehousing, analytics, and related services. The Services are currently in a pre-release, developmental stage and are not yet production-ready.

3. Account Registration & Security

• You must provide accurate registration information.
• You are responsible for maintaining the confidentiality of login credentials.
• The Company reserves the right to suspend or terminate accounts for security or misuse.

4. Data Ownership & Responsibility

• You retain ownership of all data uploaded to the Services.
• You warrant that you have the legal right to store and process such data.
• The Company is not liable for data loss, corruption, or unauthorized access. You are solely responsible for maintaining backups.

5. Disclaimer of Warranties & Limitation of Liability

The Services are provided "as-is" and "as-available" without warranties of any kind, express or implied. Kladna Soft Kft. disclaims all warranties, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of results

To the fullest extent permitted by law, Kladna Soft Kft. shall not be liable for:

• Any direct, indirect, incidental, or consequential damages (including data loss, business interruption, or lost profits).
• Any claims arising from your use of non-production Services in a production environment.

6. Indemnification

You agree to indemnify and hold Kladna Soft Kft. harmless from any claims, damages, or liabilities arising from:

• Your breach of these Terms.
• Your unauthorized or unlawful use of the Services.
• Your violation of third-party rights (e.g., data privacy laws).

7. Modifications & Termination

• The Company may modify these Terms at any time. Continued use constitutes acceptance.
• The Company reserves the right to suspend or terminate access without notice for violations or operational reasons.

8. Governing Law & Dispute Resolution

• These Terms are governed by the laws of Hungary.
• Any disputes shall be resolved exclusively in the courts of Hungary.

9. Miscellaneous

• Force Majeure: The Company is not liable for delays or failures due to events beyond its control (e.g., natural disasters, cyberattacks).
• Severability: If any clause is deemed unenforceable, the rest remain valid.
• No Waiver: Failure to enforce a provision does not waive future enforcement.
